JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-02-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307, 34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, this petitioner was driving the motor cycle and other two accused persons, who were riding on the motor cycle, caused fire arm injuries to the informant.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that no specific over act has been alleged against this petitioner and specific allegation of firing is against other accused persons. Petitioner is in custody since 08.02.2021

Patna High Court CR. MISC. No.66591 of 2021(2) dt.28-02-2022 2/2 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Patna City, Patna in connection with Gauri Chak PS case No.277/2020.
