The petitioner is in custody since 23.06.2019 in connection with Excise Case No. 1473 of 2018 registered for the offence punishable under Sections 30(A)(1) of Bihar Excise Act.

Learned counsel for the petitioner submits that his name has surfaced on the basis of confessional statement made before the police by one Dhananjay and Bipin and from the said confessional statement certain recoveries were made from the house of the petitioner, but the said recoveries were not made in his presence or from his conscious possession.
