Petitioner seeks bail, who is in custody since 08.05.2022, in connection with Mansi P.S. Case No. 41/2022 (G.R. No. 316/2022), F.I.R. dated 06.02.2022, for the offences punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
According to prosecution case, the petitioner along with other co-accused persons having armed with pistol fired upon the nephew of the informant causing bullet injury to him. Thereafter the injured was brought at Sadar Hospital, where the doctor declared him dead.
Learned counsel for the petitioner submits that the petitioner is in custody since 08.05.2022 and he has falsely been

He further submits that the allegation against the petitioner, as alleged in the F.I.R., is false and fabricated. The learned counsel for the informant and learned Additional Public Prosecutor for the State on the other hand vehemently opposed the prayer for bail of the petitioner and submits that there is direct allegation against the petitioner that he fired upon the nephew of the informant and he died on the spot. He further submits that petitioner also carried three criminal antecedent other than the present one. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Mansi P.S. Case No. 41/2022 (G.R. No. 316/2022), pending in the court of learned Chief Judicial Magistrate, Khagaria.
Prayer is refused.
However, the learned Trial Court is directed to expedite the trial and conclude at the earliest. (Rajesh Kumar Verma, J) amit/- U T
