The petitioner apprehends his arrest in Muffasil P.S. Case No. 299 of 2021, registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code.

Prosecution case in brief is that informant purchased a piece of land from the petitioner on consideration amount of Rs. 9,75,000/- and informant paid the total consideration amount in three installments, but even after lapse of five years, neither the land was registered in the name of informant nor money was returned to him.

As a matter of fact, not a single farthing has been received by the petitioner. Petitioner is a member of Panchayat Samiti and due to political rivalry he has been made accused in this case. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Muffasil P.S. Case No. 299 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
