JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Mussasil P.S. Case No. 142 of 2016, registered under Section 7 of the Essential Commodities Act, pending in the court of Chief Judicial Magistrate, Nawada.

The accusation is that the Fair Price Shop (P.D.S.) of petitioner was inspected on 26.08.2016 and in course of inspection 130.74 quintals of rice and 87.16 quintals of wheat were sold by this petitioner in black market.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly,

Patna High Court Cr.Misc. No.47078 of 2016 (2) dt.14-12-2016 his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
