The petitioner is in custody since 23.06.2019 in connection with Barhara P.S. Case No. 217/2019 registered for the offence punishable under Sections 302/34/34/120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that save and except the suspicion, there is no cogent material available on record so as to implicate the present petitioner. Case Diary in the present case has been called for which has since been received.
Learned counsel appearing on behalf of the informant submits that in paragraph No. 43 of the case diary,
Patna High Court CR. MISC. No.54143 of 2019(4) dt.27-11-2019 2/2 there is a clear indication that the petitioner had participated in the occurrence.
However, learned counsel for the State after perusal of the said paragraph submits that save and except suspicion, there is no further material on record.
Having considered the entire facts and circumstances of the case and there being a remote suspicion as against the petitioner and that the petitioner is not having any criminal antecedent, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur, at Ara, in connection with Barhara P.S. Case No. 217/2019.
