This is a petition for grant of anticipatory bail for offence under Sections 4 and 5 of the Dowry Prohibition Act. Marriage of the daughter of the informant was settled with the petitioner. After preliminary rituals the date of marriage was fixed. However, the marriage could not be solemnized as the petitioner, who was in Government job, demanded more dowry. Submission of the petitioner is that since the bride was changed the marriage could not be solemnized and on similar circumstance other co-accused have already been allowed anticipatory bail by coordinate Bench of this Court in Cr. Misc. No. 31507 of 2016 on 08.08.2016.

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with

Patna High Court Cr.Misc. No.49208 of 2016 (3) dt.19-12-2016 Complaint Case No. 102 of 2015 to the satisfaction of the Subdivisional Judicial Magistrate, Aurangabad, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
