IN THE HIGH COURT OF JUDICATURE AT PATNA
Criminal Miscellaneous No.20698 of 2015 Arising Out of PS. Case No. -26 Year- 2013 Thana -DEODHA District- MADHUBANI ====================================================== Bishwanath Mahto S/o Late Ram Briksha Mahto, resident of VillageBhadaur, P.S Deodha, District Madhubani. .... .... Petitioner
Versus
The State of Bihar .... .... Opposite Party ====================================================== Appearance :
For the Petitioner : Mr. Murari Narain Choudhary, Mr. Vijay Kumar, Advocates For the Opposite Party : Mr. Jitendra Kr. Singh No.1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 12-08-2015 This is the third occasion when prayer for grant of anticipatory bail has been made on behalf of the petitioner, the first having been dismissed on 15.07.2014 and the second ending up in withdrawal of the application on 14.01.2015.
2. Learned counsel for the petitioner submits that the petitioner has been granted anticipatory bail in connection with another similar matter arising out of Deodha P.S. Case No.54 of 2014. Moreover, the matter has since been compromised between the parties.
3. It appears, however, that unlike the other case aforesaid, the present case also involves the offence under Section 3 (1) (x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act. Learned counsel for the petitioner is unable to
Patna High Court Cr.Misc. No.20698 of 2015 (2) dt.12-08-2015 2/2 demonstrate that the same is compoundable.
4. In the above circumstances, this Court does not find any merit in the present petition. The same stands dismissed.
