The petitioners seek bail in Rupauli P.S. Case No.284 of 2016 registered under Section 302 and other Sections of the Indian Penal Code.

The informant, wife of the deceased alleged that while she was cooking food in her house, Raman Singh, petitioner No.1 and Suman Singh came and took her husband on the pretext of some work from his house but her husband did not return. In the next morning, the dead body of the husband of the informant was found.

The learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier rejected by this Court

Patna High Court Cr.Misc. No.59520 of 2017 (5) dt.11-04-2018 vide order dated 20.06.2017 passed in Cr. Misc. No.18767 of 2017 but during the course of investigation, new facts came to light. The police arrested Yogendra Yadav who confessed his guilt and it transpired that the informant herself in collusion with Mangal Singh killed her husband. The police submitted chargesheet against the informant and Mangal Singh and directed to file petition for release of the accused persons who are in custody from before but no such petition was filed. The prayer for bail of the petitioner has been rejected by the trial court only because the prayer of the petitioner has already been rejected by this Court. 6, it appears that police got material that informant herself in collusion with other accused persons killed her husband. Considering the facts aforesaid, the petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-cum-Sub Judge I, Purnea in connection with Rupauli P.S. Case No.284 of 2016.
