The petitioners apprehend their arrest in Kinzer (Arwal) P.S. Case No. 15 of 2016 registered for the offences punishable under Sections 341, 323, 420, 467, 468, 504 and 34 of the Indian Penal Code.

The informant filed the complaint on the basis of which the present FIR was registered. The informant alleged that her father got three acres of ancestral land in his share. The informant has got five sisters but her father and mother executed the sale deed in favour of the petitioners with regard to the land falling in the share of the informant and her sisters.

Learned counsel for the petitioners submits that the

Patna High Court Cr.Misc. No.39486 of 2016 (2) dt.17-09-2016 2/2 petitioners are vendee of the land from the father of the informant. The father of the informant executed the sale deed after taking consideration money. The informant has already filed title suit for partition being Partition Suit No. 20 of 2016 but it appears that the dispute is of civil nature and the father of the informant has executed the sale deed in favour of the petitioners. Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in Kinzer (Arwal) P.S. Case No. 15 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
