JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-01-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Agamkuan P.S. Case No. 101 of 2016 for the offences punishable under sections 341, 385, 379, 323, 504, 506 and 34 of the I.P.C.

When the informant was returning from the market the petitioner and others intercepted and demanded ransom of Rs. 2,00,000/- and further they assaulted the informant as well as committed theft of the ornaments and cash.

Submission is of false implication and that during investigation the witnesses, namely, Jago Yadav, Gaurav Kumar and Ravi Shankar Sinha, vide paragraphs- 8, 9 and 10 of the case

Patna High Court Cr.Misc. No.47362 of 2016 (3) dt.17-01-2017 2/2 diary, have not supported the allegation of demanding ransom as well as regarding committing theft of the ornaments and cash, the dispute is of trivial nature and due to that this false case has been lodged, the petitioner has got no criminal history and is a student of Civil Engineering in the reputed institution, namely, Crescent College of Technology, Bhopal and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes prayer for bail.

In the facts and circumstances as stated above, considering the statement of those witnesses, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M. Patna City in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
