The petitioner apprehends his arrest in Kazi Mohamadpur P.S. Case No. 10/2014, registered for the offences punishable under Sections 406, 420 and 120B of the Indian Penal Code.

Md. Noor Alam named the petitioner along with others and alleged that they persuaded him to execute the sale deed of his land but accused persons did not pay the consideration amount.

Learned counsel for the petitioner submits that the petitioner happens to be relatives of Md. Moti Alam. The petitioner is named in the FIR but no specific allegation is made

Patna High Court Cr.Misc. No.41391 of 2016 (2) dt.18-11-2016 2/2 against the petitioner. Moti Alam has already been granted regular bail. The petitioner is neither a witness nor beneficiary of the sale deed.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Muzaffarpur in connection with Kazi Mohammadpur P.S. Case No. 10/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
