JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Charadano P.S. Case No. 38 of 2016 registered under Sections 147, 148, 149, 353, 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner was neither caught at the place of occurrence nor anything was recovered from his conscious possession. Petitioner does not have criminal antecedent and only general and omnibus allegation of firing has been levelled against him.
Considering the aforesaid facts and circumstances as

No.43493 of 2016 (2) dt.29-11-2016 2/2 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt / production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Charadano P.S. Case No. 38 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul, District-East Champaran subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
