The petitioners apprehend their arrest in connection with Nautan P.S. Case No. 68 of 2016 registered under Sections 304(B) and 201/34 of the Indian Penal Code.
The accusation is that sister-in-law of the informant was tortured by her husband and in-laws due to non-fulfillment of demand of dowry and to dispose of the dead body. Learned counsel appearing on behalf of the petitioners submits that in fact, the deceased, who is sister-in-law of the informant, has died due to diarrhoea and her funeral ceremony was performed in presence of both the family members, but due to ulterior motive, this present case is lodged with false allegation by the informant. Patna High Court Cr.Misc. No.44539 of 2016 (2) dt.27-10-2016 2/2 are mother-in-law and father-in-law of the deceased and Baban Manjhi, husband of the deceased, is in custody. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IX, Siwan in connection with Nautan P.S. Case No. 68 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
