Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-08-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Obra P.S. Case no. 92 of 2019, registered under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.

The accusation is that on 13.04.2019 at 8.00 P.M. while informant was going to his house after loading the brick on tractor, in the way, petitioners and Upan Yadav having lathi, iron rod in their hands came near the tractor of the informant and started abusing him. When informant made protest then petitioner No.1 Dilip Yadav gave iron rod at his head and

Patna High Court CR. MISC. No.52857 of 2019(2) dt.23-08-2019 2/2 others also caused injury to the informant. At that time, petitioner No.3 Sintu Kumar also caused injury at the head of informant. On raising alarm, neighbours come and save the informant.

Learned counsel for the petitioners submits that petitioners are informant are Gotiya and occurrence of Marpit took place due to land dispute. Moreover, two injuries found on the person of informant are of simple in nature caused by hard and blunt substance. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Obra P.S. Case No. 92 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
