Mr. SRI SHYAM BIHARI SINGH ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 12-01-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Sursand P. S. Case no. 84 of 2017 registered for the offences punishable under Sections 363, 366A r/w 34 of the Indian Penal Code.
Allegation against petitioner is that daughter of informant, namely, Manoroma Kumari, who is studying in class XII, went to school on cycle on 23.07.2017 at 9 A.M. and thereafter did not return. From villagers it is known that the victim girl was seen with the company of son of the petitioner, namely, Deepak Kumar, on a motorcycle going towards Sursand. When informant went to the house of petitioner, she found the house locked. Inspite of her best efforts, her daughter could not be traced. She apprehends that the accused persons in collusion
Patna High Court Cr.Misc. No.59168 of 2017(2) dt.12-01-2018 2/2 with each other kidnapped her daughter for the purpose of marriage with Deepak Kumar and on such allegation FIR was registered.
It has been contended by learned counsel for the petitioner that petitioner is innocent and is mother of co-accused Deepak Kumar and she has no role in the said incident and she is in judicial custody since 25.08.2017.
Considering the facts and circumstances of the case and petitioner being a lady, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Sursand P.
