JUSTICE SANJAY PRIYA ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Nabinagar P.S. Case No. 140 of 2019, instituted for the offence under Section(s) 392 and 414 of Indian Penal Code.

It is alleged in the written report that informant after loading rice in the pick-up van at Haider Nagar, proceeded to his village. When he reached near Pandeypur, one Scorpio vehicle blocked the way. Thereafter, two miscreants got down from the Scorpio and assaulted the informant. During course of assault, they were calling the name of Sanatan Paswan. Sanatan Paswan sat on the pick up van and began to move ahead of Scorpio. At Pandeypur more, one Swift vehicle without number plate began to move ahead of Scorpio. It is further alleged that when vehicles arrived near Baghi village, miscreants snatched Rs.4,000/- from possession of the informant. The informant was put in the Scorpio vehicle and was dropped at bridge over canal near Pandeypur. The informant

Patna High Court CR. MISC. No.52449 of 2019(2) dt.28-08-2019 2/2 informed the Police and owner of the vehicle. Thereafter, the police raided the house of Sanatan Paswan and arrested him. Counsel for the petitioner submits that petitioner has been arrested merely on suspicion. The informant has taken the name of petitioner only because some dispute arose between them for Rs.55,000/- as petitioner had supplied paddy of the aforesaid amount. Petitioner is in custody since 10.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P.S. Case No. 140 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
