The petitioner seeks bail in Gardanibagh P.S. Case No. 218 of 2017 registered under Section 379 and 420 of the Indian Penal Code.
As per the prosecution case, one Anil Kumar by his mobile phone offered the informant to purchase his motorcycle and took his motorcycle on trial drive but he neither turned up nor returned the motorcycle. The mobile used in the occurrence was seized from the possession of the petitioner. It is submitted by learned counsel for the petitioner that he has no concern with the said occurrence. No incriminating article has been recovered from his conscious physical possession. The alleged mobile is hailing to accused Anil Kumar. Moreover,
Patna High Court Cr.Misc. No.54033 of 2017 (02) dt.14-11-2017 - 2 - the petitioner has been enlarged on bail by the learned lower Court regarding the recovery of the said mobile phone in Sachiwalaya P.S. Case No.86 of 2017. The petitioner has been languishing in custody since 19.08.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Gardanibagh P.S. Case No.218 of 2017.
