JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-05-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 498A, 504 and 506 of the Indian Penal Code.
The basic accusation is of torture. The factum of marriage between the petitioner and the informant and birth of a male child are admitted facts.
It is submitted by learned counsel for the petitioner that the informant earlier also filed Complaint Case No. 3883 of 2009 wherein process was directed to be issued after cognizance being taken for the offence punishable under Section 498A of the IPC and Section 4 of the Dowry Prohibition Act in which the petitioner has been granted provisional anticipatory bail.

No.22033 of 2015 (2) dt.18-05-2015 2/2 Considering the fact that in earlier complaint filed with similar accusation, the petitioner has been granted provisional anticipatory bail, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Sakara P.S. Case No. 530 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
