Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends her arrest in connection with Jamui P.S. Case No. 70 of 2021 registered for offence punishable under sections 420, 409, 379, 120(B) of the Indian Penal Code and section 66 (c) (d) of the I.T. Act. As per allegation, the question papers of social science of Bihar Matriculation Examination, 2021 were entrusted to State Bank of India and were kept in the Bank. These question papers became viral. Patna High Court CR. MISC. No.66375 of 2021(2) dt.19-05-2022 2/3 Officer, went to the Bank and found that one packet of question paper after breaking the seals, was made viral through the electronic device. These question papers, as per FIR, were entrusted to three officers.

The learned counsel for the petitioner has submitted that the petitioner is not a Bank employee, rather she is relative of Vikas Kumar, who was an employee of Bandana Solution Company and was assisting the Bank employee. He has submitted further that the FIR named accused persons, namely, Shashikant Choudhary and Ajit Kumar have been granted anticipatory bail, whereas the named accused Vikas Kumar has been granted regular bail by this Court. He has also submitted that the mobile number fromwhere the question paper is said to be made viral, was not belonging to the present petitioner. Considering the above mentioned facts and circumstances, the petitioner above named, in the event of her arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 70 of 2021, subject to condition as laid down under section 438(2) Cr. P.C.

Patna High Court CR. MISC. No.66375 of 2021(2) dt.19-05-2022 3/3 Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
