2. The petitioner seeks regular bail in connection with Special Case No. 26 of 2025 arising out of Vigilance P.S. Case No. 43 of 2025 registered for the offence under Sections 7(a) of Prevention of Corruption Act, 1988 (Amended 2018).

3. As per the prosecution case, the petitioner was caught red-handed with bribe money of Rs. 70,000/- belonging to the informant.

4. Learned senior counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 17.06.2025 and charge sheet has been submitted. There is no chance of tampering with

Patna High Court CR. MISC. No.57786 of 2025(2) dt.27-08-2025 2/2 the evidence and absconding as the petitioner is a government servant. He further submits that the petitioner is ready to pay Rs. 70,000/- to the informant without accepting his guilt.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance, Muzaffarpur/concerned Court below in connection with Vigilance P.S. Case No. 43 of 2025 subject to condition that:- (i). At the time of furnishing the bail bonds, the petitioner shall produce a demand draft of Rs.70,000/- prepared in the name of the informant. If the petitioner produces the aforesaid demand draft, the Court below shall accept his bail bonds and hand over the said demand draft to the informant.
