JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-04-2015 Heard learned counsels for the petitioner and the State. The petitioner being Panchayat Mukhia is apprehending arrest in a case registered for the offences punishable under Sections 420,406,409 and 120B/34 of the Indian Penal Code. It is alleged that the petitioner purchased solar lights at the rate of Rs.40,000/- per unit against the prescribed rate of Rs.31,492/- hence, at the rate of Rs.8508/- per unit for fourteen units the total excess payment of Rs.1,19,112/- was made. The District Magistrate directed the petitioner to make payment of Rs.1,19,112/- vide memo no. 1218 dated 19.6.2014 as contained in Annexure 2.

It is submitted by the learned counsel for the petitioner that the petitioner has deposited the said amount on 1.7.2014,

Patna High Court Cr.Misc. No.46049 of 2014 (2) dt.16-04-2015 2/2 thereafter the present FIR was registered on 11.10.2014. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Simari P.S. Case No. 196 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
