JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 09-11-2017 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek bail in connection with Rupauli P.S. Case No. 15/2012, registered for the offences punishable under Sections 363, 364, 366A and 34 of the Indian Penal Code. Daughter of the informant is said to have been kidnapped by Md. Amjad and Md. Izrul and on making complain with father of Md. Izrul, Md. Akhtar and other accused persons extended threatening of dire consequence.

It has been submitted by the learned counsel for the petitioners that in the statement recorded under Section 164 Cr.P.C., the victim has stated that Md. Amjad forcibly kidnapped her with Md. Izrul and Md. Amjad took her to Purnia in order to

Patna High Court Cr.Misc. No.53880 of 2017 (2) dt.09-11-2017 2/2 perform marriage with her. No overt act has been attributed against the petitioners. The police has submitted final form against the petitioners. The petitioners have been languishing in custody since 10.08.2017.

Considering the facts and circumstances of the case, the petitioners above named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnia in connection with Rupauli P.S. Case No. 15/2012.
