JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2017 The petitioner seeks regular bail in connection with Jamui P.S. Case No. 365 of 2016, registered for offences punishable under Section 25(1-b)a/26/35 of the Arms Act. Earlier the prayer for bail of the petitioner was rejected vide order dated 08.04.2017 passed in Cr. Misc. No. 16103 of 2017, with a direction to the trial court to conclude the trial within a period of six months and petitioner was given liberty that if the trial is not concluded within the aforesaid period, he may renew his prayer for bail.

It has been submitted on behalf of the petitioner that six months period has already elapsed and petitioner has been in judicial custody since 24.11.2016 and is ready to abide by any condition imposed on him.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.52142 of 2017 (2) dt.08-11-2017 circumstances of the case and also the order dated 08.04.2017, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui, in connection with Jamui P.S. Case No. 365 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
