JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-12-2017 The petitioner seeks bail in connection with Daudnagar P.S. Case No. 108 of 2017 dated 12.05.2017 instituted for the offences under Sections 147, 148, 149, 302 of the Indian Penal Code.

The informant has alleged that her husband had been dragged by 50-60 people and was killed mercilessly. It has been submitted on behalf of the petitioner that though he has been named in the F.I.R but so far as assault is concerned, there is a general and omnibus allegation against all the accused persons of assaulting the deceased. It has further been submitted that co-accused Badri Yadav @ Badri Singh and Chedi Yadav, both of whom are similarly situated as that of the petitioner have also been granted bail by different Benches of this

Regard being had to the aforesaid facts and the period of custody which is from 31.07.2017, this Court is inclined to grant bail to the petitioner as well.

The petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Daudnagar P.S.
