The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act.

In the F.I.R., it is alleged that four motorcycles, including the motorcycle of this petitioner were seized, in which, huge quantity of illicit liquor has been recovered. It is submitted on behalf of petitioner that petitioner is not owner of motorcycle in question. In fact, one Bishundeo Singh is original registered owner of the alleged motorcycle. However, from perusal of seizure list, it appears that petitioner is registered owner of motorcycle in question, whose registration no. is BR32C/9641.
