JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Sukhani P.S. Case No. 16 of 2016 dated 3.9.2016 for the offences punishable under Section 414 of the Indian Penal Code. The case of the prosecution is that while the police was checking vehicle, one motorcycle was apprehended and two persons, namely, Jainal and Kadir were arrested who disclosed that the said motorcycle had been provided to them by the petitioner herein. However, no papers regarding the stolen motorcycle could be produced.

The learned counsel for the petitioner submits that the petitioner has a clean antecedent, the other accused persons have already been granted bail and the petitioner is in custody

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner, above named, on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Kishanganj in connection with Sukhani P.S. Case No. 16 of 2016 dated 3.9.2016. It is further directed that the petitioner shall appear before the learned trial court on each and every date and on his failure to appear before the learned trial court on two consecutive dates, the privilege of regular bail granted to the petitioner would stand withdrawn, the bail bond of the petitioner would be cancelled and he would be taken into custody forthwith.
