Petitioners apprehend their arrest in Nauhatta P.S. Case No.08 of 2018 registered under Sections 147, 148, 149, 341, 342, 323, 406, 420, 467, 468 and 120B of the Indian Penal Code.

The gist of allegation is that Urmila Devi fraudulently sold the land in favour of the wife of Ramfal Sah. Petitioner no.2 is the identifier of sale deed and petitioner no.1 is the son of Ramfal Sah.

It is submitted that the land in question was recorded in the name of father of Urmila Devi and Urmila Devi got share.

Patna High Court CR. MISC. No.52428 of 2019(2) dt.22-08-2019 2/2 The police after investigation submitted final report stating bona fide land dispute between the parties but the learned Judicial Magistrate took cognizance.

Having considered the facts that the executant of the sale deed herself claimed to be the owner of the land by virtue of the fact that the land in question was recorded in the name of her father in the revisional survey record of rights, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Saharsa in connection with Nauhatta P.S. Case No.08 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
