JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kudra Police Station Case No. 0064 of 2015 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
Petitioner happens to be rice mill owner and it is alleged that he took paddy but did not supply rice. Admittedly, an agreement was executed between the parties and Para 13 as well as Para 15 of the aforesaid agreement revealed that in case of default the Bihar State Food and Civil Supply Corporation Ltd. Kaimur shall have a right to recover the amount by filing certificate case as well as getting order of
Patna High Court Cr.Misc. No.22635 of 2015 (2) dt.07-07-2015 2/2 attachment of property of the petitioner.Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in Kudra Police Station Case No. 0064 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C.
