This is an application for bail in connection with Ghoshi P.S.Case No. 227 of 2015 registered for the offences punishable under Sections 341, 323, 504, 379, 307 and 34 of the Indian Penal Code.

Allegation against the petitioner is of assault by butt portion of pistol to the informant causing injury to him. Submission of learned counsel for the petitioner is that had it been any intention of the petitioner to kill the informant he could use the pistol and not butt portion of pistol and he is in custody for more than two months and they are agnates and there is dispute between them with respect to lane. Heard learned APP also.

Having heard both sides and in view of facts and

No.53087 of 2017 (2) dt.14-11-2017 2/2 circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Ghoshi P.S.Case No. 227 of 2015, subject to the following conditions :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled.
