Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State and learned counsel for the informant.
Petitioner is in jail custody since 19.07.2019 in connection with Hajipur Town P.S.Case No. 486 of 2015 registered under sections 147, 447, 341, 323, 354, 504, 506, 309, 379, 307 of the Indian Penal Code.
The accusation against the petitioner is that he as well as others assaulted the informant as well as others by iron rod. Admittedly, there is case and counter case between the parties and both the parties are making allegation of assault against each others. It is also an admitted position that the
Patna High Court CR. MISC. No.55241 of 2019(3) dt.27-11-2019 2/2 petitioner was earlier granted privilege of anticipatory bail by this Court vide order dated 01.02.2019 passed in Cr. Misc. No. 1756 of 2019 but he could not surrender before the court below in time and, thereafter petitioner again came before this Court for modification of previous order but the court refused to modify its previous order.
Learned counsel appearing for the informant submits that the informant sustained injury on his frontal bone but final opinion regarding the injury of the informant was kept reserved. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VII, Vaishali at Hajipur in connection with Session trail no. 221 of 2019 arising out of Hajipur Town P.S.Case No. 486 of 2015.
