JUSTICE SATYAVRAT VERMA ORAL ORDER 11-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Mahua P.S. Case No. 568 of 2021, instituted for the offences under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 10.09.2021, charge-sheet has been submitted and has antecedent of one case and allegation is of recovery of 1883.520 litres of liquor from a truck and the petitioner after chase was apprehended as he was trying to flee. The learned counsel submits that the petitioner has falsely been implicated in this case as he was trying to flee and was caught as the petitioner was passer by and he was caught by

The learned A.P.P. vehemently opposes the bail application.

Considering the fact the petitioner is in custody since 10.09.2021, charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum, Excise Court, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 568 of 2021. The application stands allowed.
