The petitioner seeks bail in Kesariya P.S. Case No. 410 of 2018, instituted for the offence under Section(s) 420 and 379 of Indian Penal Code.

As per written report the informant got message on his Mobile phone that Rs.19,000/- has been transferred from his account to the account of Shyam Kumar Mahto. The informant went to the Bank and enquired about it. He came to know that money was transferred in SBI A/C. of Shyam Kumar Mahto. The Bank official has provided his Mobile number. Counsel for the petitioner submits that petitioner is not the beneficiary. His name has transpired on the basis of statement made by co-accused Pankaj Sah who was arrested by

Petitioner is in custody since 4.2.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Motihari, East Champaran, in connection with Kesariya P.S. Case No. 410 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
