The petitioner seeks bail in a case registered for the offence under Section 379 of the Indian Penal Code. The F.I.R. was registered against unknown for theft of motorcycle of the informant.

It is submitted on behalf of petitioner that neither looted motorcycle has been recovered from the possession of this petitioner nor he was put on Test Identification Parade. Petitioner is in custody since 01.07.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., West Champaran at Bettiah in connection with Shikarpur P.S. Case No. 58 of 2021.
