JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-06-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 307 and 120B/34 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that six miscreants came on three motorcycles and resorted to firing on the informant. The petitioners were identified by the informant. The reason for commission of the offence is that the amount of Rs.2,87,000 of the informant was due with the accused persons.

It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.23853 of 2015 (2) dt.26-06-2015 2/2 that due to the dispute related to money transaction the present case has been lodged and statement has been made in paragraph 7 of the petition that in fact the informant received no injury. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with Barhara P.S. Case No. 66 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
