Petitioner seeks regular bail in a case registered for the offence punishable under Section 341, 323, 308, 504,34 of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have caused two injuries on the head of husband of informant by means of iron rod.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that the occurrence took place on account of land dispute. There is case and counter case between the parties in which both sides sustained injuries. Kauwakol PS case No. 189/2021 which was filed by the side of petitioner is earlier in point of time. Petitioner is in custody since 16.08.2021 and investigation

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Nawada in connection with Kauwakol (Rupau) PS case No. 190/2021.
