JUSTICE BIRENDRA KUMAR ORAL ORDER 14-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/ 341/323/ 324/ 307/379/504/506 of the Indian Penal Code.

The petitioner allegedly caused injury with Tangi (a weapon of cutting) at the head and other parts of the informant. The doctor has found lacerated wound at the head of the informant and on other parts of the body also including at the neck. The petitioner is in custody since 30.10.2017.

Considering the nature of allegation and period already undergone as well as completion of investigation, let the petitioner, above named, be released after framing of the charge

Patna High Court Cr.Misc. No.1240 of 2018 (4) dt.14-03-2018 P2/ or completion of three months from the date of receipt of a copy of this order by the learned Court-below whichever is earlier, on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Jhanjharpur P.S. Case No.88 of 2015, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
