Mr.Dilip Kumar No. 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-08-2019 Heard learned counsel for the petitioner, learned counsel appearing on behalf of informant and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Suryapura P.S. Case no. 71 of 2019, registered under Sections 363, 366(A), 504 and 506/34of the Indian Penal Code. The accusation is of kidnapping of minor daughter of the informant by the petitioner with the help of his family members for the purpose of marriage.

Learned counsel for the petitioner submits that, in fact, the petitioner is the next door neighbour of the informant and he has falsely been implicated in this case due to misunderstanding and after realizing the mistake, the father of the informant filed the compromise petition in the Court below.

No.52503 of 2019(2) dt.26-08-2019 2/2 On the other hand, learned counsel appearing on behalf of informant opposed the prayer for bail and submits that victim, daughter of the informant, is aged about 15 years and she has stated in her statement recorded under Section 164 of Cr.P.C. about her carrying by the petitioner and one other from her roof and she was left after three days by the petitioner, while she has admitted that she was not misbehaved by the petitioner during the said period.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, one surety must be parents/close relative of the petitioner, to the satisfaction of the Judicial Magistrate, 1st Class, Bikramganj, Rohtas in connection with Suryapura P.S. Case No. 71 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
