Mr. Mukeshwar Dayal ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 13-04-2022 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in a case registered for the offences punishable under Sections 341, 332, 333, 379, 353, 307, 504, 34 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are in custody since 23.09.2021 and they are persons with clean antecedent.

The learned counsel for the petitioners submits that the informant alleges that he along with police force intercepted a tractor laden with sand on which the petitioners were found driving and seating. When the police tried to see the tractor, the named accused persons came and created hurdle in discharge of official duty and

Patna High Court CR. MISC. No.66578 of 2021(2) dt.13-04-2022 2/2 tried to forcefully get the tractor released, on which the petitioners fled with the tractor and while fleeing, they even attempted to dash a constable.

The learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case. No such occurrence had taken place. The learned counsel further submits that neither the petitioners have any concern with the tractor, nor they were even present at the place of occurrence, as such, they were not apprehended from the spot.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent and charge-sheet has been submitted in the case, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jamhore P. S. Case No.73 of 2021.

The application stands allowed.
