The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 420, 406, 467, 468, 471, 120(B), 506 and 34 of the Indian Penal Code.

As per allegation in the FIR, petitioner is in habit of taking bribe on the pretext of proving job. It is further alleged that petitioner has taken an amount of Rs. 3.50 lakhs from the informant to provide job to his son in Defence.

No.55522 of 2022(3) dt.17-03-2023 2/3 It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. He submitted that the amount was transferred in the account of Amit Kumar and Rajesh Kumar Pandey. Not a single amount was transferred in the account of the petitioner. No documentary evidence regarding transaction of money in petitioner's account is brought on record to support the prosecution case. The petitioner is working in Army. The petitioner and informant are coming from the same family and on account of having enemical terms with the informant, the petitioner is said to have roped in the present case. The petitioner has no criminal antecedent as stated in para-3 of the bail petition. It is also submitted that petitioner is languishing in judicial custody since 07.06.2022.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Kahalgaon P.S. Case No. 503 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with
