JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2017 The petitioner seeks regular bail in connection with Balthar P.S. Case No. 21 of 2017, registered for offences punishable under Sections 20, 22, 23 of NDPS Act. Allegation against the petitioner is of recovery of six Kg of charas.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from his possession and has been in custody for last seven months and in spite of that still charge has not been framed.
Heard learned A.P.P. also.
Having heard both sides, considering the fact and circumstances of the case and also the fact that in this case huge
Patna High Court Cr.Misc. No.50910 of 2017 (2) dt.21-11-2017 quantity of charas has been recovered, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it within a period of one year. (Vinod Kumar Sinha, J) sunil/- U T
