JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-07-2018 The present writ application has been filed for quashing the notice dated 10.01.2018, issued by Respondent No.6, the SDO, Sadar, Ara, as contained in Annexure-P/5, whereby the Principal of Arrah Central School has been directed to stop the functioning of the school till the basic amenities is made available in the school. The Principal of the school in question was further directed to appear in the office of the Respondent no.6, on 16.01.2018 at 3 PM to put his defence with regard to the school in question.

I.A. No. 4537 of 2018 has been filed on behalf of Respondent No. 8 for vacating the interim order dated 17.01.2018, passed by this Court in C.W.J.C. No. 1036 of 2018, since the writ petitioner in Eviction Suit No. 04 of 2017, has filed written statement wherein he categorically stated that building in question of the school has already been vacated.

Patna High Court CWJC No.1036 of 2018(3) dt.05-07-2018 2/2 Mr. N.K. Agrawal, learned counsel for the petitioner seeks permission to withdraw the present writ application to seek remedy before appropriate forum.

In the circumstances, this Court is not inclined to consider the Interlocutory Application.

Permission is accorded.

The present writ application is dismissed as withdrawn.
