JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with Maharajganj P.S. Case No. 129 of 2019 for the offence under Sections 302, 201, 120B and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and they are in custody since 10.05.2019.

Petitioner no. 1 is the wife of the deceased and petitioner no. 2 is the daughter of petitioner no. 1. They are suspected for commission of the crime. The basis of suspicion is that in the past, the petitioner no. 1 and the deceased were not in good relation and a case under Section 498A of the IPC was

Patna High Court CR. MISC. No.52560 of 2019(4) dt.03-02-2020 2/2 earlier lodged against the deceased.

Considering the fact that there is only suspicion against the petitioners, who are wife and daughter of the deceased, the Court is inclined to grant bail to them. the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- V, Siwan in connection with Maharajganj P.S.
