JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-01-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Eleven persons are said to have assaulted the informant with various weapons and it is specifically stated that petitioner nos. 1 and 2 assaulted the informant with lathi and sword but Annexure-3 to the petition reveals that two lacerated wounds and multiple abrasions were found on the person of the informant and opinion regarding the nature of the injuries was kept reserved till the C.T. scan report but at para-7 of the petition, it has specifically been pleaded that the informant refused to get the C.T. scan done
Patna High Court Cr.Misc. No.2535 of 2016 (2) dt.28-01-2016 2/2 and, therefore, in the aforesaid circumstance, the injuries appear to have simple in nature . It is further contend by him that there is case and counter case between the parties.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Darbhanga in connection with Simri P.S.Case No. 154 of 2015.
