The petitioners apprehend their arrest in Risiyap P.S. Case No. 59 of 2021, registered for the offences punishable under Section 379 and other allied sections of the Indian Penal Code.
Prosecution case in brief is that on the alleged date and time of occurrence petitioners along with other accused persons entered into the house of informant and started assaulting the informant and her family members with iron rod. Petitioner no. 1 took away jewellery and cash from Almirah. When informant came to rescue he was assaulted by petitioner nio. 2 Vikash Kumar. Thereafter, all the petitioners assaulted the

It is submitted that petitioners have been falsely implicated in this case. There is case and counter case. Present case is counter blast of Risiyap PS Case No. 60 of 2021 which was lodged by the petitioners side against the informant. Injuries have been found to be simple in nature. Allegations are general and omnibus in nature. Allegation of taking jewellery and cash against petitioner no. 1 is ornamental. Petitioners have got clean antecedent.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Risiyap P.S. Case No. 59 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
