JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2018 By order dated 16.10.2017 passed in Cr.W.J.C. No.1883 of 2017, the vehicle of the petitioner was ordered to be released on execution of bank guarantee of Rs.3,00,000/- (Three Lacs) in connection with Confiscation Case No.6 of 2017, arising out of Lakhisarai (Kabaiya) P.S. Case No.136 of 2017, pending before the Collector, Lakhisarai.

Now prayer is for modification of the aforesaid order to the extent that immovable property of equal value may also be accepted as surety for release of the vehicle by the authority

Patna High Court MJC No.645 of 2018 (3) dt.25-04-2018 P2/ concerned.

If the Collector, Lakhisarai, is satisfied with the document of immovable property as a surety for release of the vehicle, the Collector, Lakhisarai, may accept the document of immovable property as surety instead of bank guarantee. With the aforesaid observation, this application stands disposed of.
