The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 363 and 365 of the Indian Penal Code. It is a case of abduction of informant's son for ransom demand while he was returning to his home after closing his shop.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is not named in the FIR. His name surfaced on the basis of confessional statement of co-accused Sunil Kumar. In statement of the victim boy, recorded u/s 164 Cr.P.C. he has not whispered the name of the petitioner for his
Patna High Court CR. MISC. No.57789 of 2023(3) dt.03-10-2023 2/2 complicity in his kidnapping. In his statement, he took the name of accused Sunil Kumar as active miscreant. On the basis of suspicion, petitioner was arrested from his house and nothing was recovered from his conscious possession. Petitioner is languishing in judicial custody since 8.3.2023. Learned APP appearing for the State has opposed the prayer of Bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Jamui in connection with Sono P.S.
