JUSTICE ARUN KUMAR ORAL ORDER 23-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Saharsa PS Case No. 639 of 2017 registered under Sections 302, 120B ,34 of the IPC and Section 27 of the Arms Act.

The allegation in brief is that this petitioner and one Pawan Rajak shot at informant's son causing his death. Learned Counsel for the petitioner submits that the FIR was lodged after four hours and as an after thought name of the petitioner was included though in the case diary it is mentioned that the police after getting the information reached there then the informant named ten persons and five unknown. Others accused have been admitted to bail by this Court.

Having considered the specific allegation against the petitioner his prayer for bail is refused. The trial court is directed to expedite the trial and preferably conclude the same within a year. (Arun Kumar, J.) Snkumar/- U T
