The petitioner seeks bail in Bihariganj P.S. Case No. 169 of 2019, instituted for the offence under Section(s) 420, 406, 414 and 120(B) of Indian Penal Code.

It is alleged in the written report that informant during patrolling duty reached near ATM situated at Bihariganj Bus Stand and saw two persons in suspicious condition. On seeing the police party, they tried to run away. They were chased and apprehended. They disclosed their names as Md. Yusuf and Paplesh Kumar Yadav (petitioner). On search, two SBI ATM Cards and one ATM Card of Central Bank have been recovered from possession of co-accused Md. Yusuf whereas four ATM Cards of SBI, one ATM Card of Bank of Baroda and one

Patna High Court CR. MISC. No.52136 of 2019(2) dt.27-08-2019 2/2 Motorcycle have been recovered from possession of petitioner. Counsel for the petitioner submits that there is no specific allegation against the petitioner.

Petitioner is in custody since 25.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bihariganj, Distt. Madhepura, in connection with Bihariganj P.S. Case No. 169 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
