The petitioner is in custody in connection with Barun P.S.Case No.125 of 2016 pending in the Court of Sessions Judge, Aurangabad registered for an offence under Sections 304B and 201/34 of the IPC.

Earlier the prayer for bail of the petitioner was rejected vide order dated 11.01.2017 passed in Cr.Misc.No.652 of 2017. It has been submitted that the case was initially registered for the offence under Sections 304B and 201/34 of the IPC but after investigation, police have submitted chargesheet for the offence under Section 498A and 364/34 of the IPC. The case of this petitioner has already been committed. The petitioner is the husband of the victim and specific allegation is that he committed

Patna High Court Cr.Misc. No.62997 of 2017 (2) dt.03-01-2018 2/2 murder. It is not in dispute that the wife of the petitioner was made traceless from the house of this petitioner. There is nothing fresh material for reconsidering the bail prayer except that the petitioner is in custody for about more than one year.

In the facts and circumstances of the case, I am not inclined to reconsider his prayer for bail. Prayer is rejected. (Sanjay Kumar, J) B.Kr./- U T
